BallvsBall Terms of Service
In plain words. BallvsBall is a free game with ads and optional purchases. Coins are earned by playing; gems can be bought. Neither has any cash value. The gumball machines only ever take earned coins or free spins, never money or gems, and their odds are shown. There are no accounts: your save lives on your phone, so uninstalling or changing phones loses it. Purchases are handled by Google Play (and later Apple), and refunds follow their rules. Don't cheat, copy or tamper with the game. These terms are governed by the laws of Ontario, but nothing in them takes away rights your local consumer law gives you.
1. Who you are dealing with
BallvsBall ("the game") is published by Abdul Rahman Aldirieh, an individual developer based in Ontario, Canada ("we", "us"). Contact: support@zentorogames.com, 461 Avens Street, Waterloo, Ontario N2V 0B6, Canada.
2. Agreeing to these terms
By installing or playing the game you agree to these terms and to our Privacy Policy. The game shows a Welcome screen with links to both the first time it opens, and again whenever they change.
Under 18? A parent or legal guardian must read these terms and agree to them for you, and must agree to any purchase. The game is rated for players 9 and up. For players under 13 (or who have not answered the age screen), a parental gate asks a grown-up before any purchase and before any link that leaves the game.
3. Your licence to play
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and play the game on a device you own or control, for your own entertainment, under these terms. The game, its art, code, sounds, names and characters are protected by copyright and other laws and remain ours or our licensors'. You get no ownership of anything in the game.
4. No accounts, device-only saves
The game has no accounts and no server. Everything you earn, buy or set is saved only on your device. This means:
- if you uninstall the game, clear its data, use Delete my data in Settings, lose or replace your phone, your progress, coins and gems are gone and cannot be recovered by us;
- progress does not transfer between devices;
- the one exception is "Remove forced ads", which the store remembers and which you can bring back with Restore Purchases.
5. Virtual items: coins, gems, balls, spins
- Coins are earned by playing. They cannot be bought with money or with gems.
- Gems can be bought in gem packs through the store, or earned in small amounts by choosing to watch reward videos. Gems buy fixed, clearly described things: balls, star cards, Workshop levels. The exact item and price are shown before you confirm.
- Gumball machines give random balls and cards. They can be spun only with earned coins or with free spins won in the game. They can never be bought with money or gems, and gems never convert into coins. The odds of each rarity and of each number of copies are shown on the machine before you spin.
- Coins, gems, balls, cards, stars, spins and every other virtual item are a limited licence to use features of the game. They have no cash value, cannot be transferred, traded, sold or exchanged for money or anything outside the game, and are not property. Purchased gems do not expire. We may rebalance the game (for example change prices in coins or gems, or what a ball does) to keep it fun and fair.
6. Purchases, prices and refunds
- Purchases are made through Google Play (Android) or, later, the Apple App Store (iOS). The store, not us, takes your payment, shows the final price in your currency including any tax, and keeps the receipt. We never see your payment details.
- Prices shown in the game are examples set by us; the store's purchase screen shows the actual price you will pay.
- Refunds are handled under the store's refund policy (Google Play; Apple's policy for the App Store). If something went wrong with a purchase, contact us at support@zentorogames.com and we will help, including by processing a refund where the store lets us and the law requires it. Because gem packs are consumed as you spend them, we do not refund gems that have already been spent, except where the law requires it.
- "Remove forced ads" is a one-time purchase that removes the interstitial (forced) ads shown between levels and matches. It does not remove the optional reward videos, which you choose to watch for a reward; those stay available. It is restorable with Restore Purchases on the same store account.
- If you are in the European Economic Area or the United Kingdom, the store's checkout tells you about your right of withdrawal and how it applies to digital content you start using immediately.
7. Ads
The game shows reward videos that you choose and occasional interstitial ads between levels or matches. Ads are served by Google (AdMob) and are G-rated for everyone. They are non-personalised unless you are 18 or over and have turned Personalised ads on: it is off by default, asked once after the Welcome screen (Allow / Not now), and can be switched off any time in Settings > Ads & privacy. Players under 18 never get personalised ads. See the Privacy Policy for what that means. The reward for a video is stated before you watch, and you get it only if the video plays to the end. We do not control the advertisers and are not responsible for their products.
8. Fair play and things you must not do
You must not:
- cheat, or use hacks, bots, modified builds, memory editors or edited save files to get coins, gems, balls, purchases or "Remove forced ads" you did not earn or buy;
- copy, decompile, reverse engineer, modify, translate or create derivative works of the game, except where the law expressly allows it despite this clause;
- sell, rent, lend or redistribute the game or any virtual item, or use the game commercially;
- interfere with the ads (for example by clicking them repeatedly or using bots) or with the stores' billing;
- use the game to break any law.
If you do, we may refuse support and we may stop you from playing (section 10).
9. Updates and changes to the game
We may update, change, add or remove features, levels, balls, prices in virtual items, or the whole game, at any time. Updates may be required to keep playing. We may also stop offering the game. If we shut the game down, we will try to give at least 30 days' notice on this website; after that, virtual items (including purchased gems) will stop working, and no refund is owed for them except where the law requires it.
10. Ending these terms
You can stop at any time by uninstalling the game. We can end your licence if you seriously or repeatedly break these terms; where it is practical we will tell you why. Sections 5, 8, 11, 12, 13 and 15 survive the end of these terms.
11. Disclaimers
The game is provided "as is" and "as available". To the fullest extent the law allows, we make no promises that it will be uninterrupted, error-free, available on every device, or kept available for any length of time. We are a solo developer: support is best-effort by email.
12. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential loss, lost data (including lost saves), lost profits or lost enjoyment arising from the game, and our total liability to you for anything connected with the game is limited to the greater of (a) the amount you paid us through the stores in the 12 months before the claim and (b) CAD 50. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything that cannot be limited by law.
13. Consumer rights that these terms do not change
- Canada and Ontario: if you are a consumer, nothing in these terms removes rights you have under the Ontario Consumer Protection Act, 2002 or other Canadian consumer law.
- Quebec: if you live in Quebec, the Quebec Consumer Protection Act applies. Any clause of these terms that the Act does not allow does not apply to you, including the governing-law and courts clause in section 15 and the limits in sections 11 and 12 to the extent the Act forbids them. You may read these terms in French: Conditions d'utilisation. You have expressly asked that this contract and related documents be available in both English and French; the French version is equally valid.
- European Economic Area and United Kingdom: if you are a consumer there, you keep the protections of the law of your country of residence that cannot be waived by contract, including the digital content conformity rules, and you can bring a claim in the courts of your own country. Sections 11 and 12 apply only as far as that law allows.
- Australia: our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees or your remedies for a failure to comply with them.
- Elsewhere: if the consumer law of your country gives you rights that these terms would reduce, those rights prevail.
14. Changes to these terms
When these terms change in a way that matters, we raise the version number and the game shows the Welcome screen with a link to the new version before you play again. The current version is 1. If you do not agree with a change, stop playing and uninstall the game.
15. Governing law and disputes
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules. Subject to section 13, disputes will be brought in the courts of Ontario. Before going to court, please email us; most problems can be fixed quickly.
16. App Store (Apple) terms, for the iOS version
If you download the game from the Apple App Store, Apple's Licensed Application End User License Agreement also applies, and Apple is not a party to these terms and has no obligation to provide support for the game. If there is a conflict, these terms apply as far as Apple's agreement allows.
17. General
If any part of these terms is found invalid, the rest still applies. These terms, the Privacy Policy and the store's terms are the whole agreement between you and us about the game. We may transfer our rights under these terms to someone who takes over the game; you may not transfer yours. Our not enforcing a term is not a waiver of it.
